BY ACCESSING OR USING THE GRID, YOU AGREE TO THESE TERMS. USE OF THE GRID FEATURE IS ALSO SUBJECT TO THE GEORGIA CAMPAIGN FOR ADOLESCENT PREGNANCY PREVENTION (“G-CAPP”) PRIVACY POLICY HTTP://GCAPP.ORG/PRIVACY-POLICY. IF YOU DO NOT AGREE TO THESE TERMS AND THE PRIVACY POLICY, DO NOT ACCESS OR USE THE GRID FEATURE.
This Web Site and the Grid Feature are intended for use only in the United States (“U.S.”). If you access the Grid Feature from outside the U.S., you do so at your own risk and you are responsible for complying with local laws and regulations. This is a general audience Web Site and users of all ages are welcome to browse the Web Site. However, if you are under the age of 13, you should not provide any information about yourself on or through the Web Site.
To use the Grid Feature, you must select a “power block” on the Grid Feature and upload a message (“Message”) of no more than 130 characters and an image and video of yourself pursuant to the instructions provided by the Web Site (“Image”). You may not feature any individual other than yourself in an Image or Message. Upon your donation of your specified amount, your Image and Message will be placed in the designated location on the Grid Feature and made available for viewing on the Web Site along with the images and messages posted by other users.
You grant G-CAPP the right to copy, transmit, download, distribute, publish, publicly perform, and display those Messages and Images submitted by you, as part of the Grid Feature, in any manner made available by the Web Site and to use your name, voice, likeness, photograph, biographical information and statements as incorporated in the Images and Messages you submit for any publicity, advertising and promotional purposes in connection with G-CAPP, the Web Site and the Grid Feature in any media. You hereby irrevocably and unconditionally release G-CAPP from any and all claims, complaints or causes of action arising from use of Images and Messages in any manner consistent with these terms. You grant G-CAPP a perpetual, irrevocable, non-exclusive, world-wide, royalty free right to use Messages and Image in any form or media, now known or hereafter developed, which includes, without limitation, the right for G-CAPP (and its third party designees) to use, copy, transmit, publish, distribute, publicly display, publicly perform, create derivative works of, host, modify and edit any such Images and Messages, and to post your Messages (in whole or in part) to other websites, including, without limitation, Twitter.
You acknowledge that G-CAPP has not promised you any compensation for submission or use of your name, photo or likeness and that G-CAPP is not obligated in any way to make any use of your name, photo or likeness.
You are solely responsible for Images and Messages you submit to the Grid Feature, including without limitation, your compliance with all applicable terms and conditions in the event you forward your Images and Messages to other individuals or post your Images and Messages to other websites. G-CAPP does not endorse and has no control over the content of messages or images. G-CAPP makes no warranties as to the content of messages or images or the accuracy or reliability of any message or image and accepts no responsibility in connection with or arising from messages or images posted by users on the Grid.
G-CAPP has the right, but not the obligation, to monitor images and messages submitted to the Web Site. G-CAPP reserves the right to edit, move or remove any images or messages it deems inappropriate or unacceptable or in violation of these terms at any time. YOU WILL NOT RECEIVE ANY REFUND IN THE EVENT AN IMAGE OR MESSAGE YOU SUBMIT IS REMOVED. G-CAPP further reserves the right to prevent you from submitting Images or Messages or using the Grid and that G-CAPP has no liability if it elects to prevent you from submitting Images or Messages, using the Grid Feature or otherwise edits or removes any Images or Messages you submit.
The content on the Web Site, (with the exception of Images and Messages submitted by users), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to G-CAPP, subject to copyright and other intellectual property rights under the law. Content on the Web Site is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. G-CAPP reserves all rights not expressly granted in and to the Web Site and the Content.
You must conduct yourself in a civil and respectful manner and comply at all times with all applicable laws, rules and regulations while using the Grid Feature, including, without limitation, the following guidelines.
The Web Site may contain links to third party websites that are not owned or controlled by G-CAPP. G-CAPP has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, G-CAPP will not and cannot censor or edit the content of any third-party site. By using the Web Site, you expressly relieve G-CAPP from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to be aware when you leave the Web Site and to read the terms and conditions and privacy policy of each other website that you visit.
G-CAPP reserves the right, at its sole discretion, to revise, change, or modify these Terms at any time by updating this posting. Such notice may be given in any manner we chose that complies with law, including, but not limited to by posting a notice of such changes on the Web Site. Your continued use of the Grid Feature or Web Site after any changes will mean you accept those modified Terms. Any aspect or feature of the Grid Feature or the Web Site may be changed, supplemented, deleted or updated without notice at the sole discretion of G-CAPP.
G-CAPP takes the intellectual property rights of others very seriously and we ask users to respect the intellectual property rights of others. If you believe any Image or Message constitutes copyright infringement of (i) one of your copyrighted works, or (ii) a copyrighted work of a copyright owner who has authorized you to act on his/her behalf, please provide us with the following information:
your electronic signature or actual physical signature;
a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are allegedly being infringed, a list and description of such works;
a description of where the material that you claim is infringing is located on the Web Site, such description must be reasonably sufficient to enable us to find the allegedly infringing material;
your address, telephone number, and email address (if you have an email address);
a statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
a statement by you that the information in the notification is accurate, and under penalty of perjury, that you are the owner of the copyright in the allegedly infringed work or that you are authorized to act on behalf of the copyright owner of the allegedly infringed work.
